1 The club shall be called Palms Health & Fitness (the “club”) and shall be a proprietary club owned by Potters Leisure Ltd (the “owner“), located at Potters, Coast Road, Hopton-on-Sea, Great Yarmouth, Norfolk NR31 9BX and administered by the manager of the club (the “manager”) or by such person as the owner shall nominate.

A Palms member, including bowls and squash members on joining will become members of Potters Social Club. Potters Squash and Social Club rules are on display in the club and must be read and adhered to.

2 a Persons wishing to become members of the club shall complete the official application form included in this brochure and further copies may be obtained from the club reception. Applicants are required to submit the form fully completed to the Manager.
b Absolute discretion is granted to the Owner and the manager to reject any application renewal for membership, in such case any monies sent would be immediately refunded.
c On acceptance of an application the applicant’s details will be kept on our computer file for our use only. No details will be given to a third party (data protection act).
d Each member will receive a swipe card, which is the property of Palms Health & Fitness Club. If you/we terminate your Membership, the swipe card must be returned to the club. The swipe card may only be used by the named member and is not transferable.
If you lose your swipe card a £5.00 charge will be made for a replacement card and administration procedures.

3 a The membership year of the club shall run for such period of 12 months as the owner or the manager may determine.
b The membership fees and charges for some individual facilities shall be such amounts, as the Owner in its sole discretion shall determine from time to time. Advance warning of any change will be displayed on the club notice board. If a member wishes to cancel their membership after reading about the price changes they may do so with no penalty.
c Membership of the club shall commence from the day of acceptance.
d Membership shall be renewed monthly, annually or quarterly by payment to the Club of the amount due on or before the expiry date.
e If the Club membership is full a waiting list will be kept in operation.
f Membership is individual to that person, pair or group.
g Maximum sickness/holiday allowed is 3 weeks in any 12 month period (running from Jan – Dec) after 6 months continued membership (although each case will be given individual consideration). The club must be informed before you take holiday or at time of illness.

4 a Standing Orders - As long as the member stays on the standing order, they will continue to receive the Standing Order membership rate.
b If the member chooses to come off the standing order to pay monthly at the palms reception they will be required to pay the full membership rate.

c If a member comes off the standing order before 6 months is complete, the member will be required to pay the monthly difference of £5 per month used.

5 a The times at which any or all of the
facilities shall be available to members and guests shall be at the discretion of the Owner or the Manager. Any or all of the facilities may be closed at any time for the purpose of cleaning, decorating repairs or for special functions. If this is the case we will inform members in advance if possible. See the notice board as you enter the main entrance to the pool complex. The cost of membership takes the above into account as we are a holiday resort as well as a health and fitness club. We have a facility for the benefit of both groups.
b On entering the Club all members must report to reception and swipe their membership card. Membership details will be displayed on the computer screen including payments history.
c Except with the prior consent of the Manager, no member shall at any time introduce any guest who has been rejected as a member or had his/her membership terminated or suspended. A member introducing a guest shall be responsible for the good conduct of such guest whilst on Club premises and shall ensure such guest complies with the rules of the Club. A member shall not leave the Club premises before his guest.

6 Members and their guests are particularly advised not to undertake strenuous physical activity for which they might be medically unfit. We advise you to have a medical check up before embarking on strenuous exercise. (See rule 13)
7 Gym shoes must be worn at all times in the fitness studios. In the interest of efficiency and safety all weights must be returned to their racks immediately after use.

8 The fitness studios must be cleared 30 minutes before closing time to allow adequate time for showering and dressing. The Pools must be vacated 15 minutes before closing.

9 Members should not use the facilities of the Club while under the influence of alcohol, anti-coagulants, anti-histamines, vasoconstrictors, narcotics or tranquillizers. Those with diabetes, heart disease or high/low blood pressure should check with their doctor or members of staff that it is safe for them to use the Club’s facilities.

10 A solarium is available in a separate room. Instructions are posted in plain view and must be complied with by those using these facilities. The Owner shall not be liable for any consequences of any person failing to follow such instructions and shall be entitled to remove from the club forthwith any such person. Eye protection must be worn.

11 a Steam Room, Sauna and Whirlpool are in separate areas. Instructions and Safety Signs are posted in plain view and must be read before using and complied with by those using these facilities. The Owner shall not be liable for consequences of any person failing to follow such instructions.
b Hydrotherapy Spa, Sound Therapy, Relaxation Chair and solarium can only be used after a full demonstration by a staff member.

12 At no time will any person under sixteen years of age be permitted to use club facilities unless accompanied by an adult member who shall at all times be responsible for that persons conduct.

13 The owners and its employees will not be liable in any way for the loss of, or damage to the property of a member or guest or for personal injury or death of, any member or guest, except
to the extent that such loss, damage, personal injury or death arises from the willful, act, neglect or default of the Owner or any of its employees or agents.

14 Members and their guests are advised in the interest of security not to leave money or valuables in the Club.

15 All members and guests must please park their cars across the road from Potters main entrance at all times.

16 Any member joining between the 1st June and 31st August must join for a minimum of three months (Non refundable).

17 The Owner or the Manager in its absolute discretion may at any time terminate the membership of any member. For a major breach or several minor breaches of contract it shall be at the sole discretion of the Club Manager/Owner whether a member’s subscription shall be repayable to him/her in whole or in part in any case of termination of membership.

18 Members accept and agree to be bound by the rules of the Club on commencing their membership. These rules are displayed prominently in the club entrance. Members will be given advance notice of any changes made to the Club Rules, use of facilities or opening times.

19 The Owner in its sole discretion may at any time vary these rules or any membership fee or any charges for the use of any or all facilities. Notice of such variation shall be given to members by exhibition thereof on the Club’s Notice Board. If you do not agree with any changes you have the right to cancel your membership with no penalty.

20 Members will further comply with any directions which the Manager, instructor, security or professional lifeguards may give to ensure the smooth operation of the Club, the use of the facilities and the convenience of all members.

21 Members may use the facilities listed in this brochure. Under no circumstances will any member be allowed to use other facilities, however occasional invitations to attend a dance / cabaret in the ‘Atlas Theatre’ may be made. Failure to observe this rule will result in curtailment of membership.

22 The Bowlers Bar is available to members to use between 5.00 pm-10.00pm daily and is the only bar available for members for general use.
23 No members will be allowed on site outside of Palms normal opening hours, neither will member’s children be allowed on site outside of the normal children’s times as in Palms.

24 Members should use the lockers provided. No clothes should be left in the changing cubicles, fitness areas or on open view to aid safety and security. Lockers require a £1 coin which is refundable when you return the key back to the locker. Locker keys have a wristband attached which you should wear at all times.

25 Any dispute or difference, which may arise in regard to the interpretation of these rules, shall be determined by the Manager. If agreement is not reached, you have the right to allow an independent body to arbitrate the dispute.
